COLLABORATIVE AND SUMMARY DIVORCE

Collaborative Divorce

Collaborative divorce is an alternative to traditional divorce in which both parties hire collaboratively trained attorneys and sign an agreement to mediate a complete settlement of all child-related and property-related issues prior to filing divorce paperwork. The collaborative process often involves hiring of a third-party counselor to assist the parties throughout mediations, and sometimes, a third-party financial expert to ensure that each party is treated fairly in the agreed upon division. The collaborative process proceeds through a series of mediation sessions until a final resolution is reached.

Summary Divorce

In the event both parties are in complete agreement as to property and child-related matters, and do not need the assistance of a trained mediator, counselor, or financial expert, the parties may pursue a summary divorce. In a summary divorce, the parties file a Joint Petition for Divorce at the same time as their agreed upon Consent Judgment of Divorce. Upon receipt of the parties’ pleadings, the Court will typically schedule a final hearing of divorce without the need for any other court appearances or involvement.
