PERSONAL PROTECTION ORDER LITIGATION

Personal Protection Order (PPO) litigation in Michigan involves filing a petition with the county clerk's office to obtain a court order that prohibits violence or threats against you. It also may involve defending against the issuance of a PPO.

You may request a PPO to protect you from someone age 10 or older who is threatening, hurting, stalking, or harassing you. The Court will issue a PPO if the Court determines that there is reasonable cause to believe that the individual to be restrained or enjoined may commit 1 or more of the acts listed in subsection 1 of MCL 600.2950.

If a PPO has been inappropriately issued restraining you, you must file a timely motion to modify or rescind the PPO in order to have the PPO set aside. Court's very rarely make an exception to this deadline - it is of the utmost importance that you file within fourteen (14) days from the day you are served with the PPO or after you receive actual notice of the PPO.
